Back in June I was asked to colour the box art for 'soon to be released' retro-action dolls for these two characters from the 1960's - Captain Action and his arch-nemesis "Dr Evil"
Well Art Thibert drew them , and I duly coloured them up (twice for the Captain Action figure) and then we heard... well a lot of excuses and mucking around wanting changes, which Art and I did, and then a lot more excuses and mucking around on backgrounds... and at the end of the day? No money.
So I've emailed the people involved at least once a month since then and never received single reply, so now I decided that they're a lost cause and I'm posting these anyway. There were no contracts or exclusivity NDA's signed so I'm not breaking anything there. It was all a 'gentlemen's agreement' - but I guess Art T and I are the only gentlemen involved here. (so, sorry about the watermark this time)
Backgrounds are what I initially visualised them to be. If these ever see the light of day and are actually made into a final product then those'll be a lot different.

Art T. was telling me about the money problem you guys were dealing with when we meet at SDCC. He wanted to make sure you got paid.
That's not good.
Well, at least you're working with Art Thibert on other projects. Black and White. I hope that comes out soon. Tell him I said hurry up. I want to buy it yesterday. _________________ -Walden

Sean,
FYI, I believe I was flipping through the latest issue of Previews (comic ordering guide in the states here) that came out last month and I noticed that a Captain Action figure was being released through either Dynamice Forces or Graphitti Design or something like that and I thought I saw your art in the background. It was faded over with the text and the actual figure. I'll try to look again and let you know.
But since you colored and hadn't heard about it, be kind of crappy to have it show up but you not know about it. |

Posting these on the net and sending them an email telling them about it shook things up a bit. They suddenly sent me a flurry of emails saying how they've had money flow problems, stock arrival problems blah blah sob etc and that they had every intention of paying and I should be getting my $300 (actually its $370 which I reminded them about - deathly silence on that bit...) within the next 2 weeks....
that was 2 and half weeks ago now and haven't heard a thing since or received any money in any form....
yah-huh... right.

Sorry to hear about that. I wasn't sure if you got Previews over in your neck of the woods and if you hadn't posted the picture, I'm sure I would have never guessed you were involved. Crappy that you have to go through the battle but I'd think you'd have a case if they published your work without paying you if there was a contract in place. I'd think it would be your artwork being used without your permission. Standard waiver/freelance rules should apply.
I hope you do get paid the agreed amount for your work. Sorry you have to go through the hassle. Just trying to help you out.

sent them an email and got some replies. They claim it's only been 13 days since the last email and so they're still within their two week notice. Well if you only count the working days then yeah, they are, but I count weekends as well!
they still claim they're gonna pay up... eventually...
